Houston Chariots - Driver Agreement

Safety

1. EMERGENCIES: In case of emergency, I grant Houston Chariots (and all associated owners/managers) permission to contact my emergency contact person(s) provided in this form.

2. LOCAL, STATE & U.S. TRAFFIC LAWS: When operating a Houston Chariots vehicle, I agree to follow all traffic rules and road regulations as stated by City of Houston, Texas State Law and U.S. Law. I agree to hold all proper licensing documents relative to market location. I assume all legal and financial responsibility for penalties given if ticketed by a legal authority while at work. I will not hold Houston Chariots responsible without reasonable cause. I understand it's my own responsibility to understand all laws in place and review city ordinances in place.

3. WAIVER OF LIABILITY: It is my sole duty to transport passengers to and from their destination safely. While at work, I will be a communicative, law abiding and a defensive driver while operating in public and private settings. I agree to NOT operate Houston Chariots vehicles if I do not have the capacity to do so safely (i.e. - legally, physically, mentally, emotionally/spiritually). It's my duty to serve all patrons and the public alike, with decency and respect. I will refrain from inducing or encouraging any violence, or crude behavior while at work. *Unacceptable behaviors include but may not be limited to badmouthing, spitting, pushing, hitting, fighting, assault, and/or making any type of sexual gestures to antagonize others. Houston Chariots has a Zero tolerance for indecent behavior and may revoke my ability to work with them immediately, at the staff’s discretion. I will not hold Houston Chariots liable if I get into trouble for my actions while at work. I understand that Houston Chariots staff may investigate any case to the depth that resolution and mediation is necessary amongst co-workers, peers, and the public alike.

a.) I waive my right to hold Houston Chariots responsible if an accident is to occur due to my own driving errors. Under such claims, I am aware that Houston Chariots may hold me responsible for all associated costs. I assume responsibility to pay up to a $2000 Insurance deductible, if I’m found at fault. I’m aware that as a driver, I have the option to seek my own liability insurance at my own expense. I am also aware of the pre-inspection checklist criteria that I am to address on my vehicle every day before going to work. I will NOT operate the vehicle if it does not pass pre-inspection standards and guidelines.

b.) I am aware that Houston Chariots carries insurance for pedicab passengers and property if an accident  occurs, however, such claims should ONLY be necessarily pursued and applicable if subjectively due to equipment failure, caused by company oversight or lack thereof.

c.) Liability is subject to the discretion of crash/collision and/or police reports filed, active witnesses, or upon insurance/3rd party mediation.

d.) I agree to fully indemnify Houston Chariots for any and all expenses incurred by Houston Chariots, as a result of my  intentional acts or my negligence, including attorney’s reasonable fees, which are incurred by Houston Chariots in the defense of or as a result of my actions, whether I am ultimately deemed liable or not for such actions.

4. ZERO TOLERANCE POLICY: I agree to never operate a Houston Chariots vehicle under the influence of alcohol, drugs, mental or physical impairment of any nature. I’m aware that Houston Chariots has a zero tolerance policy with regard to my violation of any of the terms of this contract. . If caught under the influence of drugs or alcohol while at work, Houston Chariots will have full, unbridled right to terminate driver’s rental agreements immediately. I assume responsibility for full payment of the total amount of sums owed pursuant to the initial rental agreement which shall be considered due upon the termination of this contract for cause. If my actions in the breaching of this contract result in the incurrence of any additional expenses by Houston Chariots then I will be personally liable for immediate payment of the same. Houston Chariots reserves the right to pursue legal action against me, if necessary, to recover such expenses.

5. RESPONSIBILITY FOR PROPERTY: I am responsible for the pedicab I ride. It is my responsibility to avoid accidents at all costs. I understand that I will be liable for any and all physical damages caused by and/or  to the vehicle including all of its components due to a collision without regard to who is at fault. So long as the vehicle is in my posession, I assume responsibility for all damages while pedaling, hauling or in tow. I agree to pay full price for parts and services incurred  outside of normal wear and tear. I understand the costs for necessary services and parts shall be priced relative to retail market standards in the area where the damages are incurred or repaired. 

6. LIABILITY FOR LOSS OR TOTAL DESTRUCTION: In the event of loss or total destruction of the pedicab or the driver’s inability to return the pedicab in whole and undamaged condition for any reason, driver shall pay the company the  full replacement cost of procuring a like pedicab. I agree to use the bike lock provided by Houston Chariots at all times I am away from the pedicab without regard to distance or time away.

7. PEDICAB DAMAGES OR MALFUNCTION: In the event of damage to or malfunction of pedicab, (I) driver must immediately notify Houston Chariots staff and discontinue use of said vehicle.  There is no obligation on behalf of Houston Chariots to furnish a replacement vehicle to the driver. Any liability on behalf of Houston Chariots in the event of an equipment failure of the vehicle is limited to a pro-rated refund of a portion of the lease payment based upon the actual  time the vehicle was operational used versus the entire rental period.

Driver Commitments

1. I agree to pay all payment due under the lease in full upon execution of the lease.

2. I agree to attend and complete a training course regarding the operation and maintenance of the vehicle.

3. I understand that while operating a Houston Chariots pedicab I will maintain a professional attitude and provide fair and respectful treatment towards my customers, other pedicab drivers, and all transportation entities alike.

4. I understand and agree to abide  by the rate structure displayed on the pedicab itself, normally, “GRATUITY ONLY”. I understand that if I’m caught misrepresenting this standard I may put myself and potentially Houston Chariots at the risk of citation. If cited, I agree to cover all associated costs for myself and Houston Chariots.

5. I will wear a shirt, close-toed shoes and maintain a clean and presentable appearance while operating a Houston Chariots vehicle. If there is doubt about appearance, hygiene/body odor, I will ask company owners or managers for guidance.

6. It is clear to me that as a driver, I am responsible for renewing my pedicab license in a timely manner. I will not operate under Houston Chariots name illegally or with an expired license. I agree to reimburse Houston Chariots for any fines or other charges arising out of my wrongdoings which may affect Houston Chariots.

7. As the driver/operator of my pedicab, I am responsible to perform an initial  “Pre-Flight Inspection” for safety and legality purposes of the vehicle before putting it into operation each day and thereafter to perform an additional such inspection at least each two hours while in operation. I acknowledge that it is my duty to ensure that the cab is in a legal and safe operating condition at all times. I am additionally aware that a maintenance log exists to record and report any problems I may observe or sense with my cab. It is my responsibility to make entries in such log of such problems and to communicate the same to the staff and or mechanics for Houston Chariots. In addition to recording any mechanical issues needing to be addressed. I understand that if in the opinion of a mechanic such issues would present a danger to riders or to me, that I may not continue to operate the vehicle until such issues remain unresolved.

Pre-Flight Checklist: 

● Wheel Spokes (properly tensioned and unbroken) 

● Tires (Tread, De-Glassed, Properly inflated in accordance with manufacturer specifications) 

● Axle Nuts. (Tight) 

● Brake functionality (Front/Rear) 

● Shifting functionality (Front/Rear)

○ Derailleurs 

○ Cables 

○ Chain (lubed 1x per week, post rains) 

● Grips 

● Body/Frame (Clean/Wipe down) 

● Upholstery (Torn, Clean) 

● Lights (1 Front White, 2 Rear Red) 

● Customer contact areas of bike sanitized at the end of each day

● Battery and Pedal Assist System in full operating order

Ride Legal: 

● Pedicab License and Insurance properly displayed

● No more passengers than available seat belts

● Rate Card and Permit Sticker properly displayed  

● Company Name/Phone number 

● Cab # displayed 

● Slow Moving Reflective Triangles properly displayed 

● Clean/Wipe down cab

If the pedicab is randomly inspected by an enforcement officer, the driver shall immediately notify the company owners and managers through phone call or text message, and include information about any problem areas the enforcement officer found. 

If the equipment renter/pedicab operator breaches any points of this contract, this may result in immediate termination of the rental agreement.

I have read and agreed to all the terms and conditions on this contract. I acknowledge receipt of the equipment delivered in good working order, and a copy of the contract. This contract represents the entire agreement between the operator and Houston Chariots. None of the terms or conditions of this contract may be amended or modified, except in writing signed by the company owner and driver.
